Ambassador Program Terms & Conditions

These terms and conditions are a legal agreement between Vacaville and you ("Ambassador"). By signing up to be an Ambassador in the Vacaville Ambassador Program ("program") you agree to be bound by the following terms and conditions. Please ensure that you read them carefully before signing up.

Definitions:
Agreement - the contents of the contract between Vacaville and the Ambassador in respect to the Program
Program - The Ambassador program as set out on the Site and is governed by this Agreement
Ambassador - Party who agrees to take part in the Program
Link - a HTML link provided to the Ambassador to link the Ambassador's website to the Site
Site - www.vacavillebeauty.com website
IG - Instagram

The Agreement
1.1. An Ambassador must provide full legal name, valid address, e-mail address and any other information requested in order to create an Ambassador account.

1.2 An Ambassador must have a valid PayPal address to receive commission payments and include this on their profile during registration.

1.3. Vacaville reserves the right to update and change the Terms from time to time without notice.

1.4. Any modifications or changes to the Program shall be subject to these terms.

1.5. You may not use the Program for any illegal or unauthorized purpose.

Violation of these terms and conditions may result in suspension of your rights to be an Ambassador and result in lost commissions and/or removal from the Program.

Modification of Vacaville Ambassador Program terms and conditions
Vacaville reserves the right to modify or otherwise change the terms of the agreement at any time. In the case of any modifications of the terms and conditions in this agreement, it is up to the Ambassador to stay updated on the terms of this agreement as Vacaville may change terms without notice from time to time. If the Ambassador doesn't accept any modification, the Ambassadors option is to end the agreement.

Legitimate methods of advertising
4.1. Ambassadors are permitted to use links, discount codes, any related banners, or text advertisements provided by Vacaville Ambassador program.

4.2. Ambassadors are not permitted to promote any non-Ambassador program related materials, such as coupon codes provided in customer newsletters, codes provided to other Ambassadors, any promotional codes, or codes received from any source other than directly from the Vacaville Ambassador program.

4.3. The promotion should include the offer, discount code, link provided by Vacaville Ambassador program and expiration date.

4.4. Ambassadors must remove invalid codes and banners.

4.5. Ambassador coupon codes and links are not to be promoted on third party websites such as coupon databases.

4.6. Ambassadors are permitted to promote their coupon code and link on their personal social media platforms only and must not share this information on any Vacaville social pages.

4.7. Please note it is strictly forbidden to use Vacaville’s trademark and your Ambassador link on any paid advertising channels.

4.8. Any sales that have been generated through improper promotion, will result in loss of commission.

4.9. Ambassadors are discouraged from advertising any other brand of shampoo and conditioner while enrolled in the Vacaville Ambassador program. Should the Ambassador wish to advertise another brand of hair care we ask the Ambassador first reach out to us at Vacaville by sending an e-mail to hello@Vacavillebeauty.com. Should Vacaville find that the brand of hair care conflicts with our brand during the Ambassador term with Vacaville without receiving prior notification by e-mail, this may result in suspension of your rights to be a Vacaville Ambassador.

4.10. Vacaville reserves the right to take legal action against Ambassador that commits fraud.

4.11. Ambassador codes will be changed on a frequent basis and Ambassadors will be contacted with their new code. All old codes must be removed and replaced with the new discount code.

Copyrighted material
Ambassador is responsible for ensuring that product descriptions and images comply with all applicable copyright, trademark, data protection, any intellectual property right or any other applicable law. Vacaville will not be responsible if an Ambassador uses another party's copyrighted material in violation of law.

Payments (where applicable)
6.1. Ambassadors receive a commission for sending authorized sales via links provided by Vacaville Ambassador Program. The customer must make a purchase by clicking the link on Ambassador's website within 30 days of the initial click-through.

6.2. The commission is based on product that is sold.

6.3. Payout rates may be changed and they can be viewed by logging into Ambassador's account.

6.4. It is Ambassadors responsibility to determine if the payout for the link provided has been discontinued.

6.5. The commission is paid only on links that can be tracked and reported by Vacaville Ambassador Program systems. In order for systems to track the referral, the customer must have cookies enabled.

6.6. Refunded payments do not qualify for commission fee.

6.7. Payments may be revoked in the instance that a code is leaked on third party websites. It is the Ambassador's responsibility to ensure their code is not leaked.

6.8. Code restrictions. Codes are not to be posted or submitted to any coupon sites or coupon threads. Orders placed that are linked back to coupon sites will not be approved. Vacaville may change Advocate’s code if said code is located on a coupon site. If codes are continually shared on such sites, then Vacaville may terminate the Agreement immediately and without notice.

Vacaville agrees to undertake the following obligations:
7.1. Providing the Ambassador with promotional material, such as links, coupon codes, banners and any other graphic materials.

7.2. Processing all orders for Vacaville products placed by following the Ambassador's link.

7.3. Tracking the amount of sales generated through the Ambassador’s’ link and all social media content via tags and mentions.

7.4. Payment processing, cancellations, returns and other related customer service for Vacaville for the purpose of business.

Ambassador Obligations
8.1. Ambassadors are required to post 1 piece of unique, original content, on their social media platforms on a monthly basis.

8.2. 1 piece of content per month: 1 video (IG/TT/YT), 1 image (IG), OR 1(IG) story set with (3) frames, with at least one of them having a clickable link per month featuring link to vacavillebeauty.com or a unique discount and/or using your unique swipe up and tagging @Vacavillehair and @Vacavillebeauty. (Stories must be left up for a full 24 hours, and posts must be left on the feed during the contract period.)

Content can include the following items: IG feed post, IGTV, IG reel, Youtube video (review, get ready with me, tutorials), Blog post (review, tutorial), TikTok feed post featuring Vacaville, not featuring any other brand when possible with your discount code in the caption.

8.3 Instagram content must tag @Vacavillehair and @Vacavillebeauty on the photo and in the caption in order for Vacaville to track the content. TikTok content must tag @Vacavillebeauty in the caption in order for Vacaville to track the content. Youtube and blog content must link back to the Vacaville website and be emailed to hello@vacavillebeauty.com to track the content. Must use #vacavillehair and #vacavillebeauty for tracking. Posts must tag @Vacavillehair and @Vacavillebeauty and the tag must be visible and clickable.

8.4. All content must be sent directly to the Ambassador Program Coordinator via IG DM or via email to hello@vacavillebeauty.com at the end of the month for content tracking purposes.

8.5. Ambassador must be following @Vacavillehair and @Vacavillebeauty on IG, TikTok and YouTube.

8.6. Failure to follow Ambassador obligations may result in Ambassador content being overlooked and potential removal from the program.

8.7. If Ambassadors are unable to complete content, they may contact the Vacaville Ambassador Program Coordinator, via email at hello@vacavillebeauty.com, for assistance and provide reasoning.

8.8. Ambassador removal will take place if Ambassadors fail to oblige with content requirements set forth in this agreement. Detailed Ambassador Program content requirements here.

The License
9.1. Where applicable Vacaville grants to the Ambassador a non-exclusive, non-transferable, revocable right to access Vacaville site though the link in accordance with the terms of this agreement and in connection with the promotional materials provided and authorized by Vacaville.

9.2. Vacaville can use content created on social media platforms, website, ads. Ambassador will always be credited.

9.3. Ambassadors cannot modify or change any materials provided by Vacaville in any way.

9.4. Both parties agree not to use other's materials in any manner that is misleading, disparaging or in any way portrays the party in a negative light.

9.5. Any inappropriate use of the promotional material may be cause for immediate termination of the agreement.

Liability
Vacaville will not be liable to the Ambassador for the defects in the service, interruptions in the accessibility to the service, loss of data on the information handling system or viruses, loss of profits, loss caused by any third party deleting, removing, deactivating or tampering with the Ambassador tracking service or other consequential loss of whether arising from neglect or breach of contract.

Termination
The term of the agreement starts upon Vacaville Ambassador program acceptance of Ambassador's application and can be terminated by either party. Affiliation can be ended with or without cause at any time, by giving the other party notice of termination in the form of e-mail. Upon the termination of the agreement, the Ambassador will remove all links to Vacaville website, as well as all banners and graphic images provided under the program.
